Terms of Service
1. The agreement
These terms govern use of the Equalis OpsReg platform, provided by EqualisTech OpsReg Limited, trading as Equalis OpsReg (CRO SR8372443, Dublin, Ireland). By creating an account or purchasing a subscription, directly or through Azure Marketplace, you agree to these terms on behalf of your organisation.
2. The service
Equalis OpsReg provides continuous, read-only compliance evaluation of connected Azure subscriptions against deterministic rules across GDPR, ISO 27001, NIS2, DORA and PCI-DSS, producing timestamped evidence records and reports. The platform holds read-only access only and never modifies customer infrastructure. Outputs support your compliance processes; they do not constitute legal advice, and responsibility for regulatory compliance remains with your organisation.
3. Plans and billing
- Starter: 1–10 Azure subscriptions, €249/month or €2,490/year.
- Professional: 11–50 Azure subscriptions, €499/month or €4,990/year.
- Both plans include all frameworks, all connectors, and the 7-year evidence retention. Estates above 50 subscriptions are not currently served.
- Fees are exclusive of VAT. Marketplace purchases are billed by Microsoft under your Azure agreement.
4. Support
Support is provided by email for all plans, identical across both plans: Severity 1 within 4 hours, Severity 2 within 8 hours, Severity 3 within 12 hours, measured during support hours (08:00–18:00 Irish time, Monday to Friday, excluding Irish public holidays). Severity 1 means the platform is unavailable or evidence production is failing across all connected subscriptions; Severity 2 means a material feature is degraded with a workaround available; Severity 3 covers questions and minor issues.
5. Customer responsibilities
You are responsible for the accounts you create, for maintaining the Azure role assignments the platform requires, and for using the service lawfully. You will not attempt to access other tenants' data, probe or degrade the service, or resell access without written agreement.
6. Data and evidence
Evidence records are write-once and retained for seven years. Data processing terms are set out in the Data Processing Agreement, which forms part of these terms for platform customers. All customer data is processed and stored in Azure North Europe and West Europe.
7. Term and termination
Subscriptions renew per the billing period selected and may be cancelled effective at the end of the current period. On termination we will make your evidence exports available for retrieval for a reasonable period before deletion in line with the DPA.
8. Warranties and liability
The service is provided with reasonable skill and care. To the maximum extent permitted by law, our aggregate liability under these terms is limited to the fees paid in the twelve months preceding the claim, and neither party is liable for indirect or consequential loss. Nothing limits liability that cannot be limited under Irish law.
9. General
These terms are governed by the laws of Ireland, with the courts of Ireland having exclusive jurisdiction. If any provision is unenforceable, the remainder stays in effect. We may update these terms with notice; continued use after the effective date constitutes acceptance.
